Dear All,
Sorry if this does not all make sense. I have not been sleeping well since my partner received this Final Notice of warrant.
The letter stated that the Bailiff will come to remove goods for sale to pay the debt.....
What can my partner do?
The debt was to a credit card company which we had sent letters to.
Does anyone have a template that can be sent to the bailiff and court and get this removed?
If someone can help it will be greatly appreciated!
I'm not sure how to proceed?

The body of the Love For Life work commenced March 2005 and the Love For Life website started December 2006 as a response to the effects of bank and tax fraud on our family between 2005 and 2006, and the condoning of that bank fraud by Supreme Court Judges, barristers, media, politicians, public servants, big business representatives, etc. For more details, see point 5 below "If You Would Like To Read About The Cristian Family NSW Supreme Court Case". From owning two businesses and the family home, we were left with basically no means to support our four young daughters and with no "community immunity", i.e. no one standing alongside us to prevent the powers that be from stamping all over us. We have come across many, many similar cases to ours, with families being torn apart as everything they have worked hard for is stolen from them by men and women hiding behind costumes and titles and, when they look for help, there is no one around who can, or will, do anything. Most of them, like us, had unloseable court cases that they lost.
Our choice to do something about this corruption led us to follow our intuition and go right outside the square, meeting many amazing men and women along the way, coming up against the heavies of "The System" a few times and documenting the harm doing, and uncovering information we never expected to find. Realising that commerce is one of the major evils of what we call "The System", we do not charge anything for the work we do, which means that we are still very poor!
After writing many, many thousands of words and talking for many, many hours with many, many people, we have found that the truth is, of course, very simple while the lies we live under are very complicated and interwoven. Below is an explanation of the main points:
a). We live under a system that allows men and women to harm each other and earth and think they have the right to do so, and that allows some men and women to be "more equal" than others - "All Men Are Equal But Some Are More Equal Than Others"!
b). "The System" is not real; it was dreamt up in the imagination of the grand architect of "The System". It has no LIFE, no substance, and can only appear to exist through the use of and destruction to LIFE. "The System" is an artificial world, a fairytale, superimposed over the real world of LIFE and is the cancer destroying LIFE at an ever increasing rate. Another name for "The System" is "HELL". See point 1 below, "The Body Of The Love For Life Work by Arthur and Fiona Cristian". All civilisations are of "The System", they are all apocalyptic by design and all collapse because they are not LIFE sustainable, making way for the latest model of civilisation to appear out of the wreckage of the last.
"The System" uses its "Rules of the Divide" to split us up into individuals (in-divide-u-all-s) set against the fictitious background of time, space, values, measurements, commerce, dimensions, levels, planes, degrees and universes. Using third party men and women to do its bidding, "The System" is fed to us through its occults, esoterics, religions, its governments and its education, medical, psychological and scientific institutions and think tanks, etc. "The System" tells us that we are on a journey from somewhere to somewhere else or just part of a greater whole that we have no say in while rolling along and away from big bang. This splitting up causes fear and trauma (all negative, destructive thoughts and emotions, including illusion, delusion, fiction and fantasy) and provides a need for "The System" to continue to exist because, separated from LIFE (reality), we need "The System" to keep us glued together in some kind of order, i.e. oneness, a collective journey through the universe or back to heaven or off to hell.
The third party men and women of "The System" administer, govern and rule "The System" and give out the glue for us to sniff. Under the influence of the glue of "The System", LIFE here and now doesn't matter; it is what happens later, the "after-life", that counts and responsibility for what happens here and now is never an issue. Those behind "The System" who cause all the chaos and suffering of "The System", the "bad guys" are of the same fraternities, cults, sects, clubs, brotherhoods/sisterhoods, orders, etc, who send forth their "good guys", to offer the "remedies" to "The System", their remedies being nothing more than a new version of "The System" under a different guise. "Order out of Chaos", "Divide and Rule", "Divide and Conquer", "We Will Lead Every Revolution Against Us" and the "James Bond Syndrome" are the tactics they use.
c). Every man, woman and child is equal and has a creator's standing (inherent right) to a roof over their head, a few acres of land to grow food, access to fresh water and clean air and the right to pass that land on to descendants.
d). None of the powers that be will ever admit to wanting to do harm, nor will they publicly deny everyone's creator's standing.
e). LIFE is information. When we distort the information of LIFE and then eat it, drink it, process it, manipulate it, work with it, worship it, think and feel it, etc, etc, not only does LIFE become distorted but as we are part of LIFE we become distorted too. We can choose to live our lives based on information that causes harm to LIFE or on information that nurtures and supports LIFE that is who we really are.
f). LIFE IS A TEAM EFFORT - the creatures live for the forest and the forest takes care of all the creatures and all together they maintain the perfection of LIFE. MAN (men, women & children) live for the tribe and the tribe takes care of all men, women and children and all together they maintain the perfection of LIFE. We are all threads woven into the fabric of LIFE but today, many threads are fraying from the fabric of LIFE becoming in-divide-u-all-s alone, apart and severed from LIFE, incapable and unwilling to take FULL-RESPONSIBILITY for LIFE, starting with our lives and the lives of those around us.
g). "The System" can only be given some semblance of existence by causing destruction to nature (LIFE) and by enslaving men and women to maintain it. It is dead and cannot maintain or reproduce itself and has no gifts for LIFE. It needs some to have power over others, to wield their authority over those who reject the authority of "The System" and whose intention is to live outside "The System", because, if everyone decided to live outside "The System", there would be no system (no illusion).
It is in this state of disconnection from LIFE that we are able to watch and take part in all the chaos, harm, destruction, terror, poverty, starvation, homelessness, unhappiness, violence and abuse that make up "The System".
h). We were all babies and through "The System" we have all been compromised to one degree or another so it is not for anyone to pass judgement on anyone. All victims during their early years were never provided with full-disclosure. We forgive those harm doers, because they are but a product of their upbringing, and are happy to co-create a world of Do No Harm with any of them. Through our own dealings with "The System", going through its courts and being wrung out like a dishcloth, we realised that there is no "community immunity" and that, when the going gets tough, there is really no one who can help you because everyone has become an in-divide-u-all, too caught up dealing with their own pressures from "The System", too scared not to comply with "The System" or too distracted by the many temptations on offer from "The System" to be able to really step into your life and help you. This is what really got us started with Love For Life - the intention to re create "community immunity" so that men, women and children would be able to protect one another from attacks by the Powers That Be.
i). The third parties of "The System" teach children how to think and feel about everything of LIFE (reality) they see, touch, taste, feel, smell and hear, and are guided to place (covet/cloak) this information over LIFE-forms to tell them how to think and feel about them. This is done through the education system to intentionally block out all the information LIFE-forms are willingly sharing with our children directly & intimately, first party to first party, for free without a fee (no conditions or contracts attached), so that our children learn to base their lives on the information of "The System" rather than the information of LIFE.
The information of "The System" teaches us to enter the fictitious universe (universities) of The Grand Architect so that we too superimpose his dream over the dream of LIFE and be servants and slaves to his dream, which we do through all the courses and careers stemming out of his universe, his tree of life, which forms "The System's" infrastructure. Oh, that is a daffodil, it is a........ blah blah blah and does........... blah blah blah...... Oh, that is Mars and that is Venus and that is the Moon, they......... blah blah blah and blah blah blah.... They go around the .......... blah blah blah.... which blah blah blah......... etc, etc.
Whoever controls how others think & feel & causes them to act on these feelings & thoughts is given all the power by those whose thoughts & feelings are controlled. Slaves willingly create a world in their masters image without ever realising it.
And so we grow up completely disconnected from reality. We no longer remember who we really are, what we are really part of and our true purpose. The third parties of "The System" are making sure that the conclusions we reach are those already prescribed for us by the Powers That Be. This is how all aspects of the fairytale work and we are saturated by millions of them. Everything of LIFE (nature/reality) that we touch, taste, smell, hear, feel and see as 1st parties, directly gives us the information of LIFE (reality - TRUTH) it has to offer freely.
Every thought used by the Grand Architect that weaves the illusion of his universe is a CON-struct (structure of the CON) that trains us to believe in the invisible, in that which does not exist. These CON-structs are imagined/invented out-of-thin-air. Every CON-struct causes destruction to LIFE and, altogether, they form a juggernaut of harm that is sweeping over all of LIFE. The Grand Architect's shepherds of knowledge are the weavers of their founding fathers universe. This weaving of CON-structs ONLY goes on in our brains. Nowhere else does this occur because the images that represent these thought-forms will never be found in reality (LIFE - Nature - Earth). With illumined lanterns of CON-structed knowledge raised high, the shepherds guide their duped sheeple across the dangerous abyss of imagined shadows, forming the fiction of darkness that is the glorious path of all the Grand Architects descendants, his children who are the Founding Fathers of all civilisations and who are all the Founding Fathers of Freemasonry. They all serve HELL.
Through cleverness, trickery and deceit we are instructed (educated/headucated) to use our brains to believe in every CON-struct so that we put our energy into maintaining and supporting this universe of CON-structs because, without our energy, it would fade away and be no more. While we believe in the CON-structs, this world of harm doing becomes acceptable and "normal", a bizarre fantasy that we encourage one another to remain part of by ostracizing anyone who dares to tell us that things are not what they seem. Belief in, having opinions about or having faith in something (a CON-struct) have no place in reality (truth) because they are not required in reality. Belief and faith are the basis of all lies. In the middle of the word belief is the word lie. Con-structed thought and emotion is imagining what doesn't exist to be true! The belief that LIFE is an illusion is really the belief in fairytales.
In the real world of nature, we do not have to believe in anything for it to exist; we do not have to believe in a tree for a tree to exist because the tree exists regardless of whether we see the tree or not because the tree is LIFE and can sustain its own LIFE. We are also LIFE and we are here to co-create with LIFE rather than to destroy LIFE. Children left to contemplate on nature without us telling them how to think and feel will never fall for the CON.
j). Children contemplating on nature will learn never to kill an animal to eat it because they will see the animals as fellow co-creators of LIFE. Brought up by the information of "The System", however, children learn not only to kill and eat their animal friends but to destroy large tracts of rainforest and use gallons and gallons of water just to raise the cattle to satisfy their carnivorous yearnings and the $$$$$$.
Children are brought up to keep the image of Daisy the cow separate from the Big Mac they are eating. How many parents have experienced discomfort when they finally have to admit that the Big Mac is actually Daisy and the KFC Nuggets are actually Hetty and Jemima, the cheerful chooks in their favourite story? Imagine the reaction of a child taken to an abattoir to view the slaughter of pigs, cows and sheep. Then ask them to kill the animal with their own hands and see how much they really want to eat meat.
Disconnected from LIFE (nature), our children learn to destroy it rather than to nurture it and expand it. If it is natural for us to eat meat or we have a "God given" right to eat meat, why do we have to hunt animals, with boomerangs, arrows, spears, poison darts, guns, knives and other implements of death???? Why do we have to set traps for them??? Why do they resist dying for us to eat them???? If they are happy to be eaten by us, why do they not lie down and die in front of us????
And those who make the "God Given Right" claim are asked to bring forward the 1st party God to back their claim... lets see God with our eyes, 1st party to 1st party, and hear from God's tongue with our ears, 1st party to 1st party......... !!!!!!!!! They can't get their God to back their claims and yet God is supposed to be a living God, not a dead, invisible God!!!! Illusion is the basis of fraud, actors performing as supposed authorised representatives of God or even worse, impersonating God to place themselves and their claims on to a higher standing than others!!!!!!
Indigenous tribes have also been tainted by disconnection from LIFE here ("The System" of long-ago) and we must be vigilant and discerning not to fall for the myth that an indigenous background or the colour of the skin equals wisdom (consciousness). One way or another going back to our ancestors of indigenous lore, we have all been compromised by "The System".
The same applies to bread - vast amounts of land and water are needed just to make bread which is actually extremely harmful to the body. Not to mention the destruction of the soil caused by mass farming, the erosion, the droughts, depletion of minerals, etc.
The extent of the harm reflects the lack of consciousness in the thoughts that led to eating meat and bread and the resultant destruction to so much of LIFE. These thoughts without consciousness embodied are the illusions that trick us into destroying LIFE (reality).
This is not supposed to be a vegetarianism rant, rather to illustrate the harm that we can be brainwashed into doing when we are fed the information of "The System" with no reference points from LIFE to make us go, "Hold on a minute - something doesn't seem right about what we are doing."
All this harm is unthreading LIFE, including us, from the fabric of LIFE, the dream that we are. Rather than going to the cow and feeling the cow to determine its true purpose, we are deciding the purpose of the cow (dinner) based on the information provided by "The System".
This is like going to the ants, all working together to maintain their nest and to make sure that all ants are fed and sheltered, and trying to impose a new program on them, one where they are told they are "individual" ants and can do what they please without worrying about their responsibilities to the other ants in the nest. Thus, while the ants drift off on their "individual journeys", the babies die, the elderly are left to fend for themselves and rot and the nest begins to crumble and it's "every ant for himself" when it comes to food. The dream that is the world of the ant has died. This is what has happened to us; we have been given a new program that disconnects us from LIFE and allows us to destroy it without being conscious of the destruction we are causing and without taking any responsibility for it.
This lack of responsibility is why men and women in positions of power and guidance, can cause harm to their fellow brothers and sisters of LIFE - they only see the information of "The System", the statutes, rules, regulations, rituals, procedures, conditions, contracts, dogma, etc, and, thus desensitized, they do harm and forsake their duty of care, given immunity from responsibility for their actions by their uniforms, titles and standings and protected by limited liability insurance (the insurance of "The System" = chaos and anarchy). They enforce the information of "The System" over their brothers and sisters of LIFE which blocks out the information of LIFE we each have to offer our brothers & sisters of LIFE.

REMEDY
Our focus is on remedy, the co-creation of Do No Harm communities called Kindoms where we learn to live without the current system of harm doing and take responsibility for our lives, growing our own food, learning how to use our brains to their full potential and supporting and nurturing LIFE and each other as part of LIFE, providing "Community Immunity" in the face of a system that cares only for the energy it can wring out of us.
Responses from the representatives of the powers that be to the Love For Life work include many death threats (one of which was traced to the NSW Police Headquarters in Surry Hills, NSW, Australia), Arthur being followed and run off the road three times, and Fiona being kidnapped (arrested). It appears that they do not support our efforts to co-create a world of peace, freedom, joy and abundance for ALL and are trying to intimidate us from continuing. We do not report these events, bar one phone call that was traced by the local police, because we are well aware of the Freemasonic, Satanic, pedophile and sex rings that operate everywhere and that compromise many people in positions of authority.

If any religion truly had the remedy to all the suffering on earth, there would no longer be any suffering. What have Christianity, Islam, Buddhism, Hinduism, Judaism, atheism and the New Age done to end the suffering in the world?
The Love For Life website has information from all sides on many subjects, whether about Islam, Judaism, Christianity, Law, health, psychology, mind control, vaccination, aspartame, MSG, Chemtrails etc. There are over 6000 articles, documentaries etc on the website and they are so diverse that we are sure that everyone would be able to find something they loved and something they hated, if they took the time to search. If we removed all the articles hated by everyone, there would probably be nothing left! We are not anti anyone but freedom of speech is freedom of speech and no one should condemn the work of another without taking the time to research the subject themselves. Today, a representative of the New South Wales Jewish Board of Deputies is threatening to close the website down, because they have decided it is anti - Jewish and that we promote racism. What has the New South Wales Jewish Board of Deputies done to end the suffering in the world? Let's not forget the education system that brainwashes the 99% of the population that we are free and have equal rights while, in fact, we are feathering the nests of those at the top.

Well, The Obvious Option
Well, the obvious option would be "pay the debt", but I assume that isn't an option. Alternatively she can apply to the Court to pay by instalments, or if it really comes down to it she can declare bankruptcy as a way of clearing debts.
I'm a long term lurker on this site who rather enjoys the crazy banter, but as a matter of fairness I really can't stand by and let you be given bad advice. Much as this site is filled with posts claiming "I can beat every Court known to man", they're simply rubbish. Most of the law cited is from the USA and doesn't apply here, and doesn't even apply there in a way that remotely resembles what this site claims (seriously, much as it may make you feel clever to think you've found the greatest loophole ever, do you think it's true that you can send someone a 40-page letter demanding they prove they don't owe you $1billion, then rely on it when they don't reply?).
I particularly point out that for all of his claimed expertise Arthur Cristian was declared bankrupt after losing all the way through the Court system. Likewise Fiona Cristian has been disqualified from driving and has had her property seized (forcing her to pay all sorts of fees to get it back) despite all of her attempts to claim that the NSW Sheriff is a Templar/Freemason/Jewish/Space-Lizard plot. Lastly, John Wilson (whose "Legal Maxims" post was actually vaguely informative, even if somewhat misguided in its intent) has been all through the Courts and has likewise lost every challenge he's made to the debts against him, and however much he may claim those losses don't count you can bet the Sheriff will enforce them.
So, honestly, it's up to you. You can try the crazy arguments on this site, only to lose (and lose hard), or you can try to work within the system. I know "the system" has a bad name, especially around these parts, but ask yourself: did your partner in fact buy the groceries/petrol/clothes/whatever that gave rise to the credit card debt? If so, I don't see what's unfair in being asked to pay for them. While I'm sure that Arthur will respond to this post saying "No, Jane didn't buy the goods, JANE did, look how clever I am at arguing about capitalisation", the simple truth is that your partner received goods for which she would have had to pay cash if she didn't have a credit card (since you can bet the store wouldn't have taken a "UCC bond" or whatever else Arthur will claim you could have used), so what's wrong with the credit card provider asking for cash in turn?
Lastly, I acknowledge that I'm going to be flamed to hell for daring make this post on this site, but I make it with a genuine intent to help "Swiss Tony", because I feel it would not be in his interest to follow the advice posted elsewhere on this site. I'm not a member of the Illuminati, the US government, or anything like that. I just can't in good conscience let someone get taken in by what I can only describe as shockingly bad legal advice given out on this site.

I Saw Your Question And Thought I Would Have A Say
I saw your question and thought I would have a say. Similar happened to me recently and it didnt go well but I did make some interesting insights. For several years a private corp called BAYCORP has been alleging that I borrowed money from them and needed to pay it back. In a nutshell, I never borrowed any money from a BAYCORP and asked for a contract or validation of debt. Of course none of this existed. I eventually received a subpoena to Parramatta court. This invitation was only signed by the BAYCORP representative (evidencing BAYCORPS dual capacity in representing parramatta court) and had neither a stamp or seal indicating its official status. I of course refused the invitation and sent it back asking for proof of jurisdiction and signature. I received a Parramatta stamped letter a week later confirming receipt of my letter but no mention of the contents. Several months later I hear from BAYCORP declaring a default judgment had been made against me despite my having their signed stamped response letter. I later received a letter from a private corp SHERIFF, with ABN included demanding a percentage of the debt and the threat to abscond my property. I was informed by parramatta court that my only recourse was to review the registrars decision. On this day the registrar openly refused to discuss jurisdiction of the legitamacy of the document it sent and kept trying to argue BAYCORPS baseless claim.
Note, the only way to argue whether parramatta had jurisdiction was to grant parramatta jurisdiction so they could determine parramattas jurisdiction. Do you still think the courts are honest? This is why your letters are ignored. To force you into this absurd position.
Ill take a break here to mention that already an environment exists which evidences pre agreed contracts between BAYCORP and parramatta court.
The registrar maintained the current order. Possibly due to the fact that magistrates, judges and registrars who find for banks receive a percentage of the argued amount.
Once again to review registrars decision with a magistrate. Day one went well. I asked for the original proof of jurisdiction on which the registrar relied. It never came. The mag kept asking for my defense to BAYCORPS claim. I kept responding that I had no defense to claims without evidence and with no evidence no claim. If they wanted my to mount a defense they would have to provide evidence for me to defend against. I also pointed out the section 9 of the UCC shows that no contract ever existed between the two of us. I also mentioned the private nature of parramatta court. The mag asked if I was a lawyer, i said it didnt pertain to my application. He said yes it does and i said no. Mood change, and I was told to come back next week.
The next week went quickly. The mag cited some sections from the UCC and also stated that he didnt have proof of jurisdiction, he just had it. He said the stamped letter I received was not proof of contact with his court and he then notified his clerks not to respond to anyones letters again. I was also chastised for thinking that Parramatta court is a private corporation although it carries an ABN. And BAYCORP get ten thousand dollars from some little itty bitty guy who never borrowed their money. Now thats justice. I could have argued further and really threw things into turmoil but this is the case, when faced with such overt corruption and magistrates who received their law degrees from the back of cereal boxes, any other argument is futile and pointless. To further argue furthers to validate their "position".
In finish you have to understand that many pre existing contracts exist between the private corporate courts and the banks. You also have to understand that when push comes to shove they will do the overtly corrupt thing as they did to me. My advice, give em hell any way you can because they are dirt and if you dont your spineless.
The only recourse is to accept the judgment, make payments, and file for an appeal. Good luck though they are all on the same team.
After losing ten thousand I never borrowed and two children to family court I absolutely refuse to validate them any longer and most welcome their prison should it come to that. My actions now are to constantly and continually make appointments to see local politicians and basically point out this corruption and their repsonsibility to protect me from it.
Bank Debts
Dear Swiss Tony and Anonymous,
In regards to the banks and debts, the process is quite a simple one to cancel out your loan, however the more difficult area that I have found is getting the opportunity to speak with the right person about it.
In most instances, whether they be credit cards, mortgages or personal loans, you need to ask the bank one basic question:
"Did the Bank actually loan me any of it's OWN money, or did it merely monetise the loan instrument, creating a credit on account through bookkeeping entries that it then used to fund the loan. If it did, that would be an exchange, not a loan, and I did not have full disclosure that I was the source of the funds."
With credit cards it's a little different, but not much, as the initial agreed credit limit is created by your signature on the loan agreement (aka promissory note). However the banks also neglect to mention that they get a receivable from the merchant every time you make a pen or pin transaction, meaning they get credit on account.
The key here is to also ask to see a copy of the T account that created the obligation.
Any court order can be challenged, especially default judgements. What you are challenging is full disclosure. As you may know in contract law, there must be full disclosure, or the contract is null and void.
I use this method all the time with great success, as contracts are everything, wether they be marriage, birth registration, licenses, citizenship, whatever, there is always an underlying contractual obligation, otherwise these people would not be claiming that they can make you perform.
In terms of citizenship, you could challenge lack of full disclosure that you didn't know the Commonwealth of Australia was a man made legal fiction, and not a country, place or physical location.
Getting back to the banks and court, the last thing the banks want is to have to answer the questions about how the obligation was created in front of a magistrate, which is why they are doing what they are doing. They will sell the debt, rather than have to answer, and believe me, I have been trying for 6 months to get an answer for 10 clients, in all the major Australian Banks.
Out of the hundreds of people I have spoken to, bank staff, tellers, call centres, solicitors, lawyers etc, not one of them knew what a T account was (general ledger) and not one of them claimed to have any banking experience.
I agree that in Arthurs case and many other, people are using and relying on documents and methods that have been borrowed from the US, that in my opinion don't work, as they do not properly address the issue. You must always challenge the fraud, not the fiction.
I've read John Wilson's court transcript, and I can see why he gets in trouble. He doesn't listen, and doesn't know the law, and doesn't hear what the Magistrate is really asking. He also enjoins, argues and is usually in contempt.

I'm the same anonymous who made the initial reply, and you've asked a fair and direct question, so I'll answer it. (For the record, I do have some experience with these types of matters, though I'd prefer not to disclose my exact profession. Also, I stress that none of this is legal advice, go see a lawyer for that.)
To deal with the "Final Notice" you need to do something that will have the Court stay execution on the judgment that has been entered against your partner (there is clearly a judgment, since if there were not then the Sheriff wouldn't be involved). The ways to get the Court to do this are:
- Apply for an instalment order (so as to allow your partner to pay the judgment off by instalments)
- Apply for a time to pay order (which is a request for enforcement to be put on hold for a fixed period of time, to allow your partner to raise the money required to pay the judgment)
- Apply to set aside the judgment (by denying the existence of the debt)
To do any of the above your partner will need to lodge some documents with the Court in which the judgment was entered (which should be noted on the "Final Notice"). If that Court isn't conveniently located then your closest Local Court will probably be willing to give her the forms and forward them on to the appropriate Court for processing.
I don't think you really need any advice regarding how to apply for an instalment or time to pay order. They're quite straightforward and simply involve providing the Court an explanation of one's capacity to pay.
If your partner wants to set aside the judgment then she will need to provide a sworn statement explaining why she didn't respond to the Statement of Claim that would have been served on her in relation to this debt (it was probably served by post about 2-3 months ago, but if she didn't get it then that's a pretty good reason for not responding in time). She will also have to provide an explanation for the basis on which she disputes her indebtedness. Ideally this should include a draft proposed Defence (the Court will give you the paperwork for this).
If your partner applies to set aside the judgment, the Court's Registrar will review her Affidavit and decide whether it shows a sufficiently coherent defence. If they agree there is a plausible defence then they'll stay enforcement of the debt, which will stop the Sheriff, and then set down a hearing date for a Magistrate to decide whether or not the judgment should in fact be set aside. Alternatively, if they feel the claimed defence is legally hopeless then they'll still list the matter for hearing before a Magistrate, but will not stay execution in the meantime (meaning the Sheriff will proceed with their seizure).
If your partner puts in an Affidavit saying "I don't owe the debt because all banks are frauds and the Australian government is a sham" then I can practically guarantee you that the Registrar is going to consider it hopeless and will not stay execution of the judgment. Further, even if he does, there is no chance in hell that a Magistrate will set aside the judgment on that basis.
I think I've already said my piece on the absurdity of the legal arguments asserted on this site, and stand by what I've already said. All of these arguments have been run a hundred times, and they've lost a hundred times. I'd love to see a single case where a superior court has found debts aren't enforceable merely because they involve payments "on paper" rather than by way of physical money. (Before anyone posts about it, I'm aware of "First National Bank of Montgomery v Jerome Daly" in which a US Justice of the Peace purported to form a Court and find a bank's loan unenforceable. That case was appealed, overturned as being well beyond the power of the Justice of the Peace and incorrect, and Jerome Daly ended up actually being disbarred for his involvement in the proceedings (as evidence, I refer you to the Minnesota State Law Library's page at http://www.lawlibrary.state.mn.us/askfaq.html#credit). Now, whether or not you think the Court should have found that way, the simple reality is that they did, as will every other Court you end up in front of.
To perhaps say something that's going to be less controversial, I think everyone on this site will agree that the legal arguments espoused here are not going to be happily accepted by the Courts or creditors. You will end up throwing a lot of time at this, you will face a lot of hostility from authorities unwilling to accept your arguments, and you will face a lot of expenses and losses, including a very high probability of bankruptcy. If you want to run the arguments advanced around here, I'm never going to be able to stop you, but just be aware of what you're getting yourself into.

Sure, I've heard of a "proof of claim", it's a made-up document with no legal significance that is propounded by sites like this. More to the point, I don't think there's any dispute that Swiss Tony's partner signed a credit card agreement and then used the credit card to enter into a series of transactions that included promises of payment of money. For Swiss Tony's partner to now deny that would be simply dishonest, and I consider it highly unethical for everyone here to think it's fine to try to dodge a legitimate debt. If you think I'm wrong, I invite you to provide legal authority evidencing the requirement for a creditor to provide a "proof of claim" within the meaning espoused by this site.
Even if proof were required, there's no obligation on a party to litigation to provide "first hand proof". Business records (in this case, computer records demonstrating the transactions) are more than adequate, particularly given there appears to be no suggestion that they are incorrect.
Also, Swiss Tony never mentioned a debt collector, I don't know where you're getting that bit from.
If you really have been doing this for 20 years, I invite you to provide examples of your mighty victories over your alleged creditors. Otherwise, please stop accusing me of talking out of my arse.

You will also ask for the original contract, signed by two people with signatures in blue ink.
You also ask for full disclosure.

I also have an affidavit for the bank people to sign under penalty of perjury to say they have given full disclosure. They have not. The bank act states that all bills should be marked Consumer Purchase/

I wrote the secretary of the treasury asking for a certificate of protest for writing cheques on a closed account. Got letter back from the justice department stating that the secretary has no mandate to discuss this matter and no further action will be taken.
When you get a letter from a lawyer, judge, courthouse, bank police, etc, ask for the legislative law and its implementing regulations that say you must attend.

The law you seem to enshrine I do not follow. It does not live for me, its a fiction, a fairytale, and therefore I choose not to exhaust my energy/power of creation on demons. Life is a gift George. Secondly, I have little time for the legal system, couldn't really be bothered with it or the current system and as such won't usually enter into legal arguments, however, it has been said that a proof of claim is not a legal document. . . crap. . . I can draw a tree on a bit of paper and that is a legal document. Absolutely anything can be entered into the legal system. That is not to say that it won't be 'thrown out' by a judge when they consider it irrelevant or inadmissible; but up until that point (and technically even after) it was a legal document that I could base my case on. So it stands to reason, that any document that one constructs can be a legal document (these messages here can be used as evidence and thus can be called legal documents); the only problem is having a judge (who is loyal to the system one is fighting) consider it.
However even if they do 'allow' it and you win; you haven't escaped the system, you have just been suckered in by it and tricked into thinking you have beaten it, when really it has just adapted to keep you confined to it.You can't fight the system with the legal system, it's a pointless exercise in my view; all it will do is make your confinement to the current system 'easier' (but that is just in your mind anyway). I see the system, not as a controlling body of people, rather as the way we humans go about living/the general way of life/the flow of life. . .hmm, I'm finding it hard to describe. . .
Arthur is correct in saying that we are co-creators; for we create our day from the minute we awake. The problem is, humans have this thing we have labelled fear, and thus are too scared to create a different way of living. Arthurs vision of a Kindom on a grand scale has promise and is a step in the right direction, however, I do not see the general population letting go of the fear long enough for it to ever work on a grand scale.
I personally hope that something happens in 2011/2012 to wipe out 99% of the population. One hope is a device that destroys all people over the age of 3, cause maybe, just maybe some humans unaffected by the system (the only being young children) will manage to survive and grow up to create a decent and harmonious world (and thus a decent and harmonious system of living); because the human race to now is stuffed and can't be fixed, it is confined to the system we have created.

I think it is all rubbish, too. Arthur, do cows consciously co-create their reality? If so, why don't they co-create themselves out of the abattoirs and into cow controlled pastures? Legal/Illegal = fiction, contract, civil, PERSON as defined in the Crimes act 1961 of New Zealand and I guess all other common Wealth corporations (sorry countries) of the CROWN (12-14 blokes in the City of London)

Plus - yes there is more - every language must have a dictionary so as to define the meaning of the words. English has the Oxford English Dictionary Legalese has numerous legal dictionary's thus it is a different language.
I can here "George" now. Rubbish. a PERSON is a Human Being. If that is so (and this is just one example of so many) why in the legal dictionaries do they mostly use the word PERSON as do the ACTS mostly, but on describing Murder the say the unlawful taking of a human beings life?
Why do they use the word PERSON in the Crimes Acts mostly, but then change it to everyone when referring to anything of real substance such as murder. Everyone meaning all men.
But that is all fiction anyway. We know what is right and wrong do we not? But "George" will cry - but you signed an agreement and "bought" the goods. With what "George"? There is NO Lawful money backed by anything of any substance. There is only legal tender which is a financial instrument called a "promissory note". A promise to pay at some future time. With what? Exactly. Another promissory note. So please do not take the high ground when you are either a trouble maker or your brain refuses to accept the fiction that is NOT money. Only credit and debit which is ALL promissory notes and if they can continue to promise to pay then so can we right?
If you want to solve your problems (original thread) of final notices you need to educate quick and notice them of your conditional acceptance upon proof of claim and jurisdiction. You may be too late at this point.

Misuse Of Legal Dictionaries
This is a note for both freemanayres and Arthur, and anyone else on this website who consistently use legal dictionaries to back up their arguments.
Words in statutes are not, and should never be, interpreted using a legal dictionary. Judges don't purport to do so, legislators don't purport to do so, neither should you. A statute in Australia is written in English (regardless of your suggestion as to legalese - having a dictionary does not mean its a different language. Most professions have a special 'dictionary' available to them), and is interpreted using a number of methods, not including legal dictionaries. You first look at (1) the definition in the legislation and (2) a normal, English dictionary. Most of the time, this is all that is needed. A legal dictionary is a secondary aid, not primary - it simply is an author setting out common interpretations of a word - it is not law, it is not providing an exhaustive definition of an English word, but what courts might say in the past. More importantly, it usually lists an authority it is based on SO THAT YOU CAN LOOK UP THAT AUTHORITY AND UNDERSTAND THE CONTEXT! Lawyers then look up the case and the context. A legal dictionary is just a referral, not a meaning that judges will follow.
Whilst on the topic, the word 'includes' in a statutory definition does not in anyway mean that it is an exhaustive definition implying the exclusion of other words. "Expressio unius est exclusio alterius" is not a rule of general application, so stop applying it like it is. A range of cases show that it is rarely, rarely applied, and certainly not in the way that 'includes' is used in the context of most modern statutes.
If you feel like making a legal argument, based on the law, please take a little more care to get it right, and go exchange your law dictionary for a book on statutory interpretation - it will be far more valuable to you.
Misuse Of Legal Dictionaries
Exactly - when are you "freemen" going to wake up????? When in "their" jurisdiction, words mean what "they" say they mean!!!! It is TOTALLY RIDICULOUS to argue that you are not a "person" - that a "person" is a corporation, etc. To be "free" (sovereign) you must be intelligent, be educated and have the courage and volition to act on what you know. So, learn how to read and write you morons! Do some research for yourselves and stop accepting everything that you read that conforms to what you want to 'believe'. Can you write a sentence in 'now' time that expresses a single idea and that can be read forwards and backwards? Mathematics is the manipulation of symbols that 'reflect' reality and mathematical equations must conform to this - what makes anyone think that language shouldn't do exactly the same??? Laziness?? Stupidity??? You don't deserve to be sovereign! You are all morons!!!

Bailiff orders
Hi i have been reading thru the bailiff comments after trawing the web for an answer to my question. so can you knowledgable people help me. I moved out of rented accomdation 2 1/2 months ago and made a mutal agreement with my landaldy for her to keep the $1290 + $100 pet bond for any repairs to the house needed when we left. not gross repairs, just wear and tear. i made this agreement as we had been there 3 1/2 years and i am a reasonable person who knows that there will be some maintenece done. so my landlay agreed and i made over the whole bond to her. then some 3 weeks later she sent me a letter listing new "repairs" she had to make and demanding $1300 extra. I of course refused. now it appears she has engaged a debt collector to try to recover this "debt". my question is this, can she obtain an bailiff order on the strenght of her allegations or does she have to prove the debt first. the debit is, by the way, for new carpets which she tore up rather than clean as she wants to now sell the house. so can she just say " you owe me this" and get a judgement without me being told? or does she have to get a judgement against me first. i want to dispute this in court as i have photos of how the house was when we moved in and when we moved out and that the carpets were fine (just needing a clean). what i dont want is a knock on the door and a bailiff just walking in taking stuff. as far as i am concerned there is no debt, she is trying to make me pay for her re decoration so she can sell the house. can anyone help with this. I would be extreemly grateful. thanks

When debt collector contacts you ask for a copy of the contract he/she/they have with you (contract 1st party to 1st party) - If they have no contract WITH YOU (which they don't - they are 3rd party strangers - they were not there) you do not have to perform for them. Tell them that if they call you again, you will go after them for harassment, intimidation, extortion, fraud, etc..... Note: When debt collector contacts you again, you do not have to answer the phone or door with your name or acknowledge/reply/confirm that it is you they are looking for - Ask them if they have a contract with this person you are looking for. If they say yes, tell them to send a copy of the contract to the person by mail (you do not have to tell them your address) - if they have a contract 1st party to 1st party, they will have the address) - Without a contract they have nothing - The only party who has a contract is the 1st party landlady - You already have evidence of attempted extortion, fraud, intimidation, etc.... against you... If you were to go to court (even if they threaten to take you to court "we'll see you in court" etc, great.... when your in court ask for the contract they have with you... without a contract they have nothing.... Watch out for trickery.
