COUNCIL vs PTY LTD in a NSW Local Court and Common Law Jurisdiction

Hi,

Have been browsing this site for a few weeks researching Common Law Jurisdiction in Australia. I have a question regarding a case coming against a friend who owns a small cafe in NSW, who has been issued with multiple fines from his Local Council for 'spruiking'. Its a small family business, he is the sole director of his PTY LTD, the infringements have been issued in his company name (with the Council logo and the Ranger only identified by his RANGER Number!).

The fines are trumped up claims. The Rangers have stated on each of the fines that his staff and himself were seen 'spruiking'. Apparently this Council and its Rangers thinks that by talking to someone outside your own cafe with a menu in your hand is spruiking (note - none of the staff were calling out loudly, or obnoxiously approaching people - no-one was injured - they were simply talking to people who had stopped to look at his menu boards).

The fines amount to THOUSANDS of dollars!! Its ridiculous. This is a small family business simply trying to run a cafe and earn an income.

Can he still identify himself as the flesh and blood of his COMPANY NAME PTY LTD and claim Common Law Jurisidiction?

And once he has identified himself as the flesh and blood of his COMPANY NAME PTY LTD in this court hearing, would this affect him if Council or anyone else continued to pursue him in any future court cases against either himself or his Company Pty Ltd?

From my understanding, he would approach the stand before the Magistrate - identify himself as First Name Surname, the flesh and blood of COMPANY NAME PTY LTD, and state "I wish to claim Common Law Jurisidiction".

When the Magistrate asks 'How to you plead' he would reply "I plead guilty to the FACTS, not guilty to the charges". He would then be entitled to have the facts heard and COUNCIL would need to a) identify itself in flesh and blood; b) provide proof that he was spruiking in EACH of the infringements; c) have an injured person take the stand for EACH of the infringments served; and d) provide a witness to EACH of the infringements.

Would appreciate any feedback!!

No, that wouldn't work, largely due to the fact that "Common Law Jurisdiction" doesn't mean anything like that.

Further, if he's pleading guilty to the facts, why would they have to prove the facts?

If he tries running that crazy argument, would you be so kind as to post here afterwards with the outcome of the hearing? It rather irks me that this site always hands out dud advice, yet we never hear about how badly it fails...

Thanks for your response....have considered your point.

The issue here is - the infringements are for "spruiking" (or in legal terms, not operating in compliance with Council laws under DA blah blah blah, which include no 'spruiking' - however 'spruiking' is not a clearly defined term). No where on the infringements does it state the word 'spruik', they simply state that a staff member of the cafe was seen to approach a person in public with a menu in his hand, and spoke to that person. If that is a fact, then you must plead guilty to the FACT yes?

But just because he spoke to someone on the street, does that constitute a crime? What the Council is claiming is that, by speaking to someone on the street with a menu in your hand, DOES constitute a crime, a breach of the Council by-laws, and warrants a $660 fine. The Council claims that this is 'spruiking', and under THEIR law, you are not allowed to do this.

Consider this : If I'm walking down the street, and you look at me, you stop and engage me in conversation, and you hand me your business card.... under this Council's law, you are guilty of 'spruiking'. If a Council Ranger witnesses that, he can then issue you with a fine for $660 for illegal spruiking. Is that fair? Would YOU pay the fine?

How would you plead? Guilty to the fact? YES. Guilty to the crime of 'spruiking'? You tell me.

In This Particular Case You Don't Need To Use That Technique

In this particular case you don't need to use that technique when you can fight it.. Plead guilty to the FACTS isn't really necessary when u can fight them at their own game and win.

Alot of cases can be fought on principal alone as councils are just trying to make money. They scare people into paying by playing on their ignorance. This case could be fought on the evidence alone. What do they have to prove that someone wasn't just talking on the street? Does that mean anytime you see someone in uniform with a menu on the street speaking to people they are guilty of the same crime?

This "law"(without seeing it) could be a direct violation of your common , constitutional, and natural law right to freedom of association.

Most importantly what evidence do they even have?

Can you give some more details about the law for these "infringements" and in which state/council?

To Spruik Or Not To Spruik

Habeas Corpus section 8 is the best defence. By putting a plea you are accepting their jurisdiction in one sense but in another sense a not guilty and a challenge to the legislation that the council rely is a strong notice to the Council that their by-law is in contradiction to the law and therefore has to be treated as VOID. Their own Local Government Act says that. Section 109 of the Commonwealth Constitution is our best back up, please study this section for yourself.

Well I Suggest In Such A Case That They Shouldn't Plead Guilty

Well, I would suggest in such a case that they shouldn't plead guilty to anything, facts or otherwise (since I doubt the penalty notice gives detail as to whether the staff were seen "talking" or "spruiking").

I don't know what the law is regarding "spruiking", nor do I know exactly what happened in this case. However I wouldn't begrudge anyone for raising a defence relying on a dispute over the meaning of "spruking", that's a perfectly legitimate argument.

They (police officers, sheriffs, bailiffs, politicians, judges, barristers, lawyers etc etc) ALL look at (worship) "The Crown" (their master). The Beast is the fairytale and Satan is "The Crown" the copyright holder of the fairytale.

This is what CIVILISATION is ALL about; renting the intellectual proprietary knowledge from the copyright holder. All the ideas owned by the copyright holder are FICTION because the IMAGES of each and every CON-struct (the ideas) copyrighted, do not exist as part of creation. They are nowhere to be found. Our senses of creation (sight, sound, touch, taste, feel, smell/scent) cannot engage with them to expand our consciousness because they are ALL DEAD. To con-struct a physical/material form of any of these copyrighted CON-structs requires the total destruction (death) to conscious-living life-forms of creation, inanimate or not and the removal of their consciousness, altering/distorting/manipulating their conscious-living DNA into an artificial-dead dna (form).

By removing the consciousness (the conscious-living information) out of the life-forms of creation they become DEAD-CORPSES and The Crown" governs ONLY DEAD CORPSES. "The Crown" ONLY has jurisdiction over the dead world of dead PERSONS that is civilisation. Everyone involved in this fairytale are insane, deluded and have most definitely lost the plot. This fairytale civilisation is a ship being sailed by a ship of fools. The ship of fictitious Persons is sailing on the high-seas of Admiralty Law and all are doomed, heading very shortly towards total and utter destruction. No one can take on creation and think they can get away with it. They all lose THEIR REAL LIVES no matter the route taken.

The whole infrastructure of the Western World Civilisation of Commerce relies on cleverness, trickery and deception to keep us (CON us) within its boundaries. The Law and those working for the bar and government etc are there to keep us in our place and make sure we do not stray out of our Establishment enclosures, along with other Establishment lackeys whose job it is to ensure that anyone attempting to escape is ridiculed and scapegoated to deter others from doing the same. They tell us that we have to use the law, that there is no other way and that we are idiots and lunatics for attempting to do otherwise.

The only remedy is when MAN returns to who we really are; fully conscious gifts of creation (co-creation). The virtues of love are wide and varied and we all have unlimited access to use them, to co-create our creation of life with them to maintain full-responsibility for our creation of life; sincerity, purity, nurture, inspire, support, give, gifts, care, help, grow, feed, groom, observe, share, guide, protect, empower, confront, truth, sensitivity, empathy, compassion, conscience, etc, etc, without ever DOING HARM to life.

It is impossible to Do Harm when we are co-creating with the virtues of love. Being Fully Responsible means consciously co-creating ONLY with the virtues of love and always saying NO to any form of harm doing, directly or indirectly. When we are focusing on images of fantasy, fiction, illusion, delusion and fairytales, images that are beyond our senses of creation to engage with, images that are without SUBSTANCE (consciousness) embodied, we are putting our energy/power of creation into causing destruction to creation starting with the MAN/WOMAN/CHILD we are fully responsible to co-create.

When we put our focus (our energy/power of creation) into fictitious images like person, ego, mind, individual, fashion, sport, competition, gambling, drugs, alcohol, sex, money, credit, debt, mortgages, loans, subsidies, bills-of-exchange, promissory notes, currency, finance, bonds, insurance, penalties, fines, interest, charges, taxes, licenses, registrations, certificates, contracts, accounts, permits, titles, deeds, invoice, receipts, statements, courts, parliaments, governments, corporations, affidavits, notice of notion, statutes, laws, rules, regulations, rituals, procedures and conditions, etc, etc, thousands and thousands of man-made con-structs, we are projecting destruction to creation (life) because we are propping up (SURVIVING) these dead-corpse images.

We have to do everything for these dead corpses because they are DEAD turning us into slaves which takes us away from our living partners, children, families, friends, communities, nature, world, etc. Dead Corpses can't walk, talk, eat, poo, create, reason, contract, negotiate, move, etc, etc, of their own freewill and this is why we have to put all our energy/power of creation into them so they can appear to have life. And so we have given up our real lives and our real world to prop up a dead one.
