The fabulous result of Serena's quick release was attributed to David T in Melbourne who has really learned well how to hold perpetrators to account.

When he learned Serena had been kidnapped by the Gestapo he immediately tracked her down and told the jailers that his 'sister' (from another mother) had been wrongfully kidnapped and incarcerated and was now the injured party.

He needed to know who was in charge and who kidnapped he so they could be held accountable and liable.

The 6 weeks incarceration lasted 4 days.

David is one of many silent 'heroes' fighting for people's rights in Melbourne and now many others are catching on around the country.

STATEMENT OF CLAIM RELATING TO THE UNLAWFUL KIDNAPPING AND ILLEGAL INCARCERATION OF
The living breathing life force soul of woman commonly addressed as Paioro : Moeau

On 13th August 2008 at approximately 12 midday, I returned to my place of residence after taking my eldest son to a work interview. My husband Matt told me the police had been around and left a calling card. They had also told him that they would be back in 2 hours to arrest me. I immediately called my brother and asked him for advice. He advised me that I should call the police immediately and find out what their visit was regarding. I then called the number on the card left by the police who came earlier. The person who answered my call said..”I knew it was you Serena” I asked the person for her badge number and said I would not continue the conversation until she gave it to me. She replied that I did not need her badge number and that she would give it to me when she came over. She then asked if I was home. I again asked her what the matter was pertaining to. She again refused to give me any details over the phone except to say that I would find out what it was all about when they got to my place.

“About 30 minutes later, I heard some loud banging on my front door, my office window and on the garage door. I could hear voices over the noise of the banging but could not hear clearly what was being said. My son who was upstairs was too frightened to come down because of all the banging. My husband was out at the time. I ran to the front of the house where the office is located to see if I could see who it was without being seen. The banging persisted loudly so I opened the door.

On opening the door I saw a large group of police officers standing at the front door. An officer with the name tag Snr Constable Liz Brown immediately placed her foot over front of the door opening to prevent the door from being closed. I asked her to remove her foot...she refused. I again asked her to remove her foot from the doorway. Again she refused and then grabbed me by my right arm and forcibly pulled me outside. Snr Const Liz Brown flashed some papers in front of my face and then said “We are not going through all that again Serena....., we have had enough”. An older male officer with the name Dickens on his badge had also grabbed my left arm. Another tall male officer then grabbed my left arm and twisted upward behind my back. This caused me excruciating pain and I screamed out that they were hurting me. I told the tall male officer there was no need for him to do that as he may break my arm. Both he and Snr Liz Brown then replied “Yes we do”

I had my hands forcibly pulled behind my back and was then handcuffed by an Officer with the name tag Ray Schrember. I was then put in the back of the police vehicle by Const Liz Brown and another female officer with the name tag Const Allen. I overheard Officer Ray Schrember ask Constable Liz Brown if there was anything else they could do, to which she replied “No thank you”. Officer Ray Schrember then said “Always happy to help”.

I was then taken down to the Werribee Magistrates court by Officers Brown, Allen and Dickens. There was a problem removing my handcuffs on arrival as neither Officers Brown, Allen nor Dickens had keys to unlock the handcuffs. The handcuffs were eventually removed when another Officer brought some keys. When the handcuffs had been removed I used my mobile to call my brother to let him know what happened. He then told me he would get to the court as quickly as possible and told me to let them know that he was on his way to assist you. Officer Dickens and Brown then made a grab for my mobile phone and said that while I was in custody they had to take my phone as I was not allowed to use it. I pulled the phone away and said I am contacting my brother to let him know what has happened. He then repeated that I was not allowed to use it while in custody and then grabbed it from me.

I was then asked to take a seat at the front area on the ground floor near the reception area of the Werribee Magistrate court. The registrar David Christie approached me with some documents and then asked me if I knew why I was in custody. I replied I did not. He then turned to the last page of the set of documents he held and said “If you sign here you will be released immediately and you will then be required to attend Sunshine Magistrates Court on Oct 2”. He then asked again if I understood, to which I replied I did not.

I was in a total state of shock and felt absolutely numb. At approximately 2 pm my husband and I were told to go upstairs to face a magistrate. On the way up an officer warned my husband that if I did not sign the documents shown to me by Registrar David Christie, I would appear before a Magistrate at exactly 3 minutes past 2pm and if the documents had not been signed I would be remanded in custody until the court hearing on Oct 2, 2008. This information caused severe emotional trauma to my husband and left him in a very distressed state while waiting for the Magistrate.

Shortly thereafter Magistrate Bentley entered the court room. As I was feeling nauseous and was in shock Const Allen grabbed my arm and lifted me to my feet. I was then asked by the court clerk if I was (a name I had not heard before was stated by the clerk) I replied that I was not. Magistrate Bentley then repeated the question and I replied “No” again. He then asked what the name people call me by. I asked who do these men and women say I am. He then said “You are not asking the questions here I am”. He then asked me when I was born. I replied I did not know. Magistrate Bentley then asked if there was anyone in the courtroom who could identify me. Constable Allen who had been sitting next to me, stated she could identify me. Magistrate Bentley then asked Const Allen to go into the witness box. Const Allen held the bible in her hand without being prompted by the court clerk then swore an oath that she would tell only the truth.

Magistrate Bentley then asked “Do you know this woman” to which she replied “Yes” Magistrate Bentley asked Const Allen how she was able to identify me. Const Allen replied that the last time I was in court with Magistrate Toohey I was identified from a photograph on a drivers licence containing my birth date and address. Magistrate Bentley then asked Const Allen “Did you prove her identity on the day and confirm it. Const Allen replied she had. I objected and said I had not seen any material evidence to show that I am the alleged debtor on the documents before the court. This was ignored by Magistrate Bentley.

Magistrate Bentley then asked if I understood why I was at the court and then said “You are here in regarding a debt owed by you to someone, do you understand that?” I said no. He said “You are here because you owe someone money and they want the money. Do you understand that?” I replied that I did not. He then asked Cons Allen, if I had legal aid to which she answered no. He then instructed Const Allen to take me outside and find legal aid and deal with it. I objected again saying I haven’t any material fact or evidence that show I am the alleged debtor. I repeated this a number of times but was ignored by Magistrate Bentley. Const Allen and Const Liz Brown led me outside of the courtroom and downstairs to wait for legal aid.

While waiting with my husband, a female legal aid with the name Ms Hughes approached me and led me into a private room. She asked me if I had ever been diagnosed with a mental illness, I replied that I had not. She asked me what my name was to which I replied I have no first-hand knowledge of my name. I said God gave me my first name and I don’t know what that is. She asked “What do people call you”’ I said some people call me Mom or aunty. Then she asked if my name is Serena. I said no. She then asked where I lived to which I replied I live on the land commonly called Werribee.

She asked for the paperwork that I had in my possession. I showed her various documents including an affidavit for the claimants, an affidavit of truth in name signed by myself, a certified true copy of the crown security titled “Birth Certificate”, a written warning that all person/s approaching my place of residence would be deemed as trespassers if they did not have a written invitation from me and a list of Maxims in Law. The police officers and registrar refused to accept or acknowledge the documents when I proffered it to them when we first arrived at the Werribee Magistrates court.

She then showed me the document titled Birth Certificate and asked if the name on the document was my name? I said no. She then asked who the birth certificate belongs to. I said it was a crown security which I brought to court to turn over to crown office bearers. She clearly did not comprehend what I was saying. She asked me if I understood why I was there on that day. I said I did not. She then said it is a civil matter and you owe someone some money. I then told her that the matter she was referring to was settled in the private and I have not been shown anything that rebutted my affidavit pertaining to the alleged debt. I also added that no-one had shown me any affidavits that supported claims made in the court or that there was proof of the claims being made. I then stated that the matter had already been settle in private by me in my capacity as the primary creditor, beneficiary in the original jurisdiction on behalf of the alleged debtor and I did not know why I had been brought to the court against my will, when the matter had already been settled to which documentary evidence is available.

She said that she knows nothing about any settlement, she is only there to advise me that if I don’t sign the bail then I will be held at the Sunshine Police Station to the next court hearing date which is 2nd October 2008. She asked again if I understood what that means…I replied that I did not. She then asked if she could have photocopies of my paperwork I had in my possession, I refused. She tried holding on to my papers but I pulled it away. I said if you want the signature from the person on your documents, you have to ask that person as I am not that person. You have to make the person named on the birth certificate or their trustee sign the document. I am neither the trustee, surety or the person named on that document.

She then said “We are not here to judge your beliefs but you have to understand that while you are in our legal system you must abide by our rules. She said the paperwork that I had in my possession had no legal status and whatever the court says goes. She asked if I understood and I replied that I did not. She then became angry and asked if I wanted her help or not. I said “From your actions it does not appear that you are helping me at all. She then asked “Is that it?” I said yes and she stood up and walked out and went and spoke to the Registrar. I walked out of the room and sat down alone as my husband had to pick up our 10 year old son from school. I was worried for my safety as everyone including the police, magistrate and legal aid were angry because I would not sign a document I had already told them I did not understand. I could not understand why I had been arrested and why I needed to sign bail documents on a matter that was already settled.

Officers Dickens, Brown and Allen then came and told me we had to go. I was lead to the police car outside the court and then taken to Werribee Police Station. I was taken to a small room where Officer Brown and Allen wearing blue gloves asked me to empty my pockets, remove my coat, blue jumper, singlet, belt, jeans, sock and shoes. When I had undressed down to my underwear Officer Brown then asked me to lift the bottom of my bra up. Fearing that I would be injured, I complied. The officers checked through my clothing, placed my belongings into a plastic bag and then asked me to get dressed.

I then asked Officer Brown and Allen if they felt good being actors in blue uniform. Officer Brown replied “Shut the fuck up” I then said to Officer Brown “Are you not now injuring me and if you are where is my remedy ”? She replied that I did not have one. I was left to get dressed. A few minutes later a male not dressed in uniform came in and identified himself as a police officer. He advised me that the documents I had, carried no legal status and said to me “I don’t know what you are trying to prove here but it aint going to work” He then left the room and Officers Brown and Allen then led me out to the police car and drove me to Sunshine remand centre.

On arrival my personal belongings were passed to Snr Constable TD Johnston who then proceeded to list the items on his computer. Officer Johnston then asked Officer Brown why was I there? Officer Brown said I was there because I failed to identify myself and refused to sign the bail. Officer Johnston asked who I was and Const Liz Brown replied that my name was Serena and she said to me, “We can call you Serena, can’t we? I replied that she could call me anything she wanted to. She turned to TD Johnston and said “She really has another name but she does not go by her name and we have an identity crisis and she won’t state who she is. While Const TD Johnston continued to note down my personal belongings, Officer Brown told me to stand against the wall, where she commenced without my consent to take a pictures of me.

I was then asked by an Officer Nicole to step into a room where I was asked to strip again. While I was undressing Const Allen stepped inside and advised const Nicole that they had already stripped searched me at the Werribee Police Station and she did not have to strip search me unless she wanted to. Const Nicole said “Ok, we will stop here”. I was asked to get dressed. I was lead out of the room and told to step on a black line on the floor where they checked my height. After TD Johnston had taken down all their necessary requirements, he advised Officers Brown and Allen they could leave.

Officer TD Johnston then asked me to sign a form confirming the contents of my belongings and that the contents were held in custody by the police on my behalf. I was then asked to sign a release form as my husband was out the front and my belongings would be passed to him.
Officer TD Johnston told me that my husband now had my belongings and my husband had asked to see me but was told that my husband was not allowed. He then said I could see my husband on Saturday if I had not been moved to the women’s jail in Deer Park. I started crying as Const Nicole led me to a cell.

I was so traumatised by the way I had been treated I cried all afternoon and evening as I was so worried for my children, I could not eat or sleep but was encouraged to keep my strength up by another Vietnamese lady in the same cell. She helped keep me warm. In the evening I needed to use the toilet and did not realise that I was being filmed while going to the toilet until an inmate told me. During the night Officer Johnston and another female Officer came to bring us some refreshments. Officer Johnston then asked me why I was there and I said I do not know. He said only criminals were held there and I was here on a civil matter. He then asked me if I understood what a civil matter was and I replied that I did not. He explained a civil matter is when I owe money to someone else and that if it is not paid they will bring you here if you have not paid the money. I then explained that the matter I have been told I was here for had been settled some time ago. He asked if I had proof of it being settled and I replied that I did. He then advised me to seek legal aid in the morning and see if they can take it a step backwards. He asked if I understood what bail is. I replied that I did not. He then explained that I am required to sign a piece of paper which is called a promissory note where I am promising to the court that I will appear at the court on Oct 2, 2008 to deal with whatever matter that they were accusing me of. He then asked “You did not understand that?” I explained to Officer Johnston that I had not slept in 72 hrs and had not been well for sometime.

I thanked officer Johnson and I told him that nobody had explained it to me the way he did. I told him that they should have explained it to me like he did as it was a lot more clearer. He then said “You have a rest, have a good night sleep, when you wake up in the morning I won’t be here, but tell the officer in charge that you want legal aid and if they take you to the women’s prison tomorrow, tell them that you want legal aid. I asked him again if I could see my children and husband. Officer Johnston said I could only see them on Saturday and Sunday and if I was still in Sunshine Remand Centre he would personally make sure I was able to meet with my family.

I thanked him for his kindness and understanding and went to lie down on the bunk. I could not sleep as I was worried for my children and I knew they would have no understanding of why I was in jail as I did not even understand the reasons I was in jail.

14th August 2008

The next morning after breakfast I went to lay down as I had very little sleep. I was woken by Police Officers who advised a group of inmates and I that we were being transferred to a female prison in Deer Park. We were then taken by a police vehicle to the Dame Phyllis Frost Centre for Women. On arrival we were held in a waiting room. While we were waiting an officer came to ask us our bra size, our shoe size and what type of cigarettes and drinks we wanted. I was then taken into an office where another picture was taken of me. After a few more details were taken from me two female prison officers wearing blue rubber gloves lead me to another room where I was asked to remove all my clothing. When I was naked I was instructed to bend over. I was then asked to stretch out my arms and then I was asked to lift my feet and show the soles of my feet to the prison officers. I was given prison clothing, soap and a towel and was asked to take a shower. I then asked one of the officers if I could have a Bible. A prison chaplain then brought in a bible and sat with me for sometime.

I was later taken to a holding cell where I sat for approximately 40 minutes. A female then came to see me and advised me that she was a psychiatric nurse. She then asked me a number of questions including if I drank, smoked cigarettes, took drugs and other questions I do not recall. A doctor who was present decided that after talking to me that I did not need to have any blood test taken.

At approximately 4.45pm when I had finished with the doctor an officer came and told me that my brother would come and pick me up at 5.30 pm and that I have got bail. I have been totally shocked and traumatised by the last few days and still fear being arrested by police because I do not understand how I can be arrested for a matter that had already been settled in private.

I, the free woman on the land commonly addressed by the name Paioro : Moeau hereby make this statement of claim as to the events leading up to my unlawful kidnapping by Officers named herein and subsequent incarceration at the Sunshine remand centre and finally being held against my will at the Dame Phyllis Frost Centre for Women.
